Attorneys fighting for your right to Fair Wages and Fair Treatment across California
Cases and Class Actions » Cessna v Southern California Edison
While we've filed a Motion for Class Certification, we're also getting ready to try this case, if that's necessary. Of course, that depends on the courts, and where we are with Covid-19. So we need to know. Did this happen to you?
Did you ever work overtime and get paid straight time?
Did you ever have to work through the night and get NO OVERTIME?
Did you ever have to get work done, and then BE TOLD IT WASN'T APPROVED AND NOT GET PAID FOR IT?
Do you have documents you can show us where this happened?
PLEASE. PLEASE CALL US. We need to know who was treated like this. We need your help - their help - at trial.
AND AND AND - if you've been recently fired, whether from SCE or anywhere else, reach out to us. Same if this happened to any of your family, friends or colleagues. You and they can either call 818-547-5200 or 626-795-0205.
Or you or they can email us at Tom@falveylaw.com.
Think of who you might be helping! Thanks.
Are you now or were you a Planner II, working for So Cal Edison in the past few years? If so, you probably remember getting overtime until January 1, 2017. Then suddenly, only straight time.
Not exactly Happy New Year, was it? That’s what we’re fighting for. For you to get those unpaid wages.
So if you are or were such an employee or know anyone who works or who has worked for So Cal Edison since January 1, 2017 who has or had the title of Planner II, would you please contact us? Or tell those people to do so?
It doesn’t matter whether you worked in So Cal Edison's maintenance of their transmission or their fiber optic lines. Or whether you were such a Planner involved in maintaining their power generation facilities, for example hydropower planners.
Same thing, if you are or were a Distribution Planner since January, 2017. We need your help, and we’d really appreciate your contacting us.
Call us at 626-795-0205 or 818-547-5200. Or email us at firstname.lastname@example.org.
AND ... Do you have any documents you think would help? Pictures, texts, emails, timesheets, schedules? Anything? We'd love to get them from you. Thanks in advance.
We and all those employees can use your help.
On January 4, 2018, our firm filed a Complaint (see attached) on behalf of the Plaintiff, Mr. Cessna, for Civil Penalties under the Labor Code Private Attorneys General Act (PAGA) of 2004, Labor Code 2698, et seq., against Southern California Edison (hereafter sometimes referred to as “SCE”).
This case is being brought on behalf of Technical Planner 2 employees of SCE who worked in California at any time since October 2, 2016.
In his lawsuit, Plaintiff contends that Southern California Edison did not comply with the requirements under California law, and specifically failed to provide those employees with payment for all hours worked, including overtime wages.
Plaintiff has also pleaded in his complaint that SCE failed to provide adequate off-duty meal periods and meal period compensation and for rest periods and res period compensation.
Further, Plaintiff claims that as a matter of policy, Southern California Edison knowingly and intentionally provided Plaintiff with wage statements that, among other factors, don’t show all wages earned, all hours worked, or all applicable rates.
Plaintiff also contends that, as a matter of policy and/or practice, SCE failed to pay Plaintiff all wages due and owing upon termination of employment, including, but not limited to payment of wages for off-the-clock work, overtime compensation and missed meal and res periods compensation.
The court has not yet ruled on any of Plaintiff's allegations or determined whether the case is appropriate for class action status.
If you are now such an employee, or were an employee of Southern California Edison in California since October, 2016, we would like to speak with you.
You may have documents relating to your job there, such as copies of checks, schedules, pictures of your training requirements or materials, forms you had to sign, manuals, emails, letters, time-sheets, or instructions about training, etc. If you could provide those to us, it might help us and others to see them.
Thanks for all the help you can send our way. Your call or email might go a long way toward helping these employees, and thus the public at large.
