JUDGE GRANTS REQUEST FOR FINAL APPROVAL OF CLASS ACTION SETTLEMENT!

Well over 350 people, almost 80% of the class filed claims. We've talked with many of you throughout the past few years, and are grateful that we could achieve this result.

So here's the result of all the work we undertook and your filing those claims: We're very pleased and grateful to announce that the Honorable Robert Freedman, Judge of the Alameda County Superior Court, granted plaintiffs’ motion for final approval of the class action settlement entered into between the parties.

To those of you who helped us reach so many of the class members, we thank you all for your efforts and assistance.

Update 1/10/12 - Only TWO Days Left To File a Claim Form. Over 300 Class Members - More Than Two Thirds of the Class - Have Already Filed Claims!

We've learned of many people who either did not get their claim forms, or threw them away, not understanding the possible value their individual claim might have. If you're one of those people, you still have time to get your claim timely filed, but it must be filed by January 12, 2012!

This class action is not about a coupon or a discount if you buy a product. We’ve all gotten those, and often ignored them altogether. For those of you who are members of this class action, your filing can possibly represent a very substantial check.

Please understand: While we might have an idea who might be in the class members, we do not know which people are in the class until they tell us a) they filed a claim, or b) they received a claim form. Some people, who we were originally understood were class members, are not in this class action, because they filed a claim form in another class action (covering the period for which this case also covers).

So if you don’t know if you’re a class member, please IMMEDIATELY contact the claims administrator, CPT Group, Inc., at 855.829.1027 (16630 Aston, Irvine, California 92606), to obtain the claim form. REMEMBER: it must be filed by January 12, 2012!

Please do so RIGHT NOW, while you still have time. Sometimes, two-three months after we close a class action, about the time that checks go out, we get calls from people wondering if they can still file their claim. Update - 12/30/11 - Less Than Two Weeks Two File a Claim - And Important News Regarding Severance Agreements and Arbitration

Please keep this in mind: if you plan to file your claim, you must do so by January 12, 2012! If you’ve put off filing until you could get to it, now’s the time to fill it out and return it to CPT!

On another matter altogether, it’s come to our attention that some people who are potential class members are concerned about possible retaliation by AT&T for having filed a claim. AT&T's attorney has assured us that anyone in the Pierce Class who may have signed a severance agreement is not thereby precluded from filing a claim under the settlement. He believes our settlement agreement and the class notice already so state.

He has made it clear that AT&T will not take any action to try to bar any such claims under the settlement or otherwise retaliate against anyone who files a claim.

We also want to mention the recent communication AT&T sent to certain employees regarding signing an offered arbitration agreement.

As AT&T’s counsel pointed out, the agreement states,

"This Agreement does not apply to any pending lawsuit that was on file in any federal or state court and to which you were a party as of December 1, 2011. Nor does this Agreement apply to any pending alleged or certified class, collective, or representative lawsuit that was on file in any federal or state court as of December 1, 2011, in which you were reasonably identifiable as a class member (or in the case of representative action, a beneficiary) as of that date."

In his and our opinion, this makes it clear that nothing in the arbitration agreement which you might or might not sign in relation to your employment has any bearing on your participation in the Pierce settlement.

Over 200 people have already filed claim forms, and more are doing so every day. For those of you who have held off filing a claim form, either because you were concerned about the possibility of retaliation, or the potential arbitration agreement, this should greatly relieve your concerns.

Finally, we need your help. We recently became aware of four people who had not gotten their claim forms. There certainly may be more than that. As we’ve written before, claim forms can be lost in the mail, misaddressed, or misdelivered. So if you, or anyone you know who you think should be part of the class, has not received a claim form, such people should IMMEDIATELY contact the claims administrator, CPT Group, Inc., at 800-542-0900 (16630 Aston, Irvine, California 92606), to obtain the claim form. REMEMBER: it must be filed by January 12, 2012!


November 25, 2011 - Claim Forms Go Out Monday, November 28, 2011!

Recently, the court granted our Motion for Preliminary Approval of the Settlement reached between the Plaintiffs and Defendants. As a result, an envelope with the Claim Form and supporting documents will be mailed out this coming Monday.

Members of the class are defined as Associate Project Manager IT, Project Manager IT, and Senior Project/Program Manager IT. If you worked in any of those positions for AT&T Services, Inc. in the State of California since March 30, 2006, and you have not received your claim form by the second week in December, you should IMMEDIATELY contact the claims administrator, CPT Group, Inc., at 800 - 542-0900 (16630 Aston, Irvine, California 92606), because you must file your claim within the time period allowed. You can also contact CPT if you have any questions about the claim form.

IMPORTANT - We recommend, when you mail back your completed form, that you BE SURE to keep a copy of the completed form in a safe place. Treat it like a check. We also strongly suggest that you mail it Certified Mail, and Return Receipt Requested. Be sure to keep both the receipt you get at the post office, and the return receipt when it’s signed for, in a safe place as well so that if your claim is somehow lost, you will be able to show you submitted it on time. Update - October 26, 2011 - Settlement of Class Action Given Preliminary Approval

We are pleased to inform you that the court recently granted preliminary approval of the settlement we've entered into with AT&T Corp. (see order attached).

If you worked for AT&T since March 30, 2006 as an Associate Project Manager IT, Project Manager IT, and/or a Senior Project/Program Manager IT in the State of California, you should be receiving a claim form from CPT Group, Inc., the Third Party Administrator of this class action, within about a month. Please DO NOT discard that claim form. This is not junk mail. This is not about a discount for a product you can buy. It is about your possibly receiving money if you are a class member and the court grants final approval of the class action settlement early next year.

If you do not receive a claim form by late November, and you believe you are a member of the class, please contact CPT at 16630 Aston, Irvine, California 92606, (800) 542-0900 and/or our office at (626) 795-0205. We DO NOT know the names or contact information of all class members. Thus it is very important, if you believe you are a member of this class action, for you to take action to protect your rights.

If you do receive the claim form, and believe, as we do, that this is an excellent result and wish to file a claim, we have some recommendations. First, be sure to complete the form. Next, be sure, after completing a form, make a copy to keep in a safe place. When you return it, we recommend that you mail it Certified Mail, Return Receipt Requested, and keep all three documents in a safe place.

If you were employed by AT&T in California in any of those positions at any time since March 30, 2006, you may wish to contact our offices if you were required to work more than 8 hours in a day or 40 hours in a week, or if it was necessary for you to work through meal breaks, or forego meal and/or rest breaks altogether. This may have happened, for example, as it has for other employees, when you were working on 'releases,' as well as at other times during your workweek.
