A proposed class-action lawsuit has been filed by Jerry Wong, Juan Pineda and Ronald Del Valle ("Plaintiffs") against AT&T Mobility, Inc. on behalf of Retail Sales Managers of that company who worked in the retail stores of defendant throughout the State of California. Plaintiffs allege that, by the nature of the work they were required to do, they were misclassified as exempt employees, at any time during the four years preceding the filing of the original lawsuit filed by Jerry Wong on October 19, 2010. The case is entitled Jerry Wong, an individual, Juan Pineda, an individual, and Ronald Del Valle, individual, on behalf of themselves, all others similarly situated and the general public vs. AT&T Mobility, Inc. et al, Case No. CV10-8869 GW (FMOx) consolidated with CV11-1768-GW (FMOx) (United States District Court, Central District). A copy of the consolidated complaint is attached hereto for your review.
In this lawsuit, Plaintiffs Wong, Pineda and Del Valle contend that AT&T Mobility, Inc. did not comply with the requirements under Federal and California law for payment of wages. If successful, a class action allows former and current employees to receive back wages that are owed to them.
The court has not yet ruled on any of Plaintiff's allegations or determined whether the case is appropriate for class action status.
